Standing Yovation® Official Rules

NO PURCHASE IS NECESSARY.
THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE CONTINENTAL UNITED STATES.

1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. Standing Yovation® ("The Standing Yovation® Promotion") is open to legal residents of the Continental United States (and excluding where otherwise prohibited by law, rule or regulation), who are 18 years or older at the time of entry (except in the case of legal residents of certain states where the age of majority is greater than eighteen (18) years of age, such age of majority). Employees, officers, and directors (including immediate family members and members of the same household) of Pierre's Ice Cream Company (the "Sponsor"), and each of their affiliated companies, subsidiaries, distributors, retailers, printers and advertising and promotion agencies, and any and all other companies associated with The Standing Yovation® Promotion are not eligible to participate. The Standing Yovation® Promotion is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law, rule or regulation.

2. HOW TO ENTER: The Standing Yovation® Promotion entry period begins at 12:01 AM Eastern Time ("ET") on 06/29/09 and ends at 11:59 PM ET on 08/15/09 ("Entry Period"). There are two ways to enter: online, or by mail. No other method of entry will be accepted. Entrants need only enter one time to be eligible for the summer-long promotion. Entries will remain in the drawing pool throughout the length of the promotion (excluding winning entries).

a. Online Method: During the Entry Period go to www.myyovation.com/standingyovation.shtml and click on the link to access the online entry form for the Standing Yovation® Promotion. By submitting your complete name, organization name, date of birth, telephone number, e-mail address and nominee's name, age group, organization name, address, city, state, ZIP/postal code, telephone number and e-mail to the Sponsor via the online entry form, your nomination will be automatically entered in The Standing Yovation® Promotion. Entrants must complete all required data requested on the online entry form. Incomplete entries are void. Entrants are required to nominate someone they feel deserves a Standing Yovation® and describe, in 300 words or less, why the nominee should be recognized. (Entries should clearly explain how the nominee's actions had a positive impact on a community or the lives of others. All decisions of the judges shall be final and shall not be subject to review.

b. Mail-in Method: If you do not have internet access and would like to enter The Standing Yovation® Promotion, please mail your name, organization's name, address (city, state and zip), phone number, date of birth, the nominee's name, age group (18-35, 36-55, 56-over), nominee's organization (if applicable), nominee's address (city, state and zip), nominee's phone number and an explanation (300 words or less) why your nominee deserves a Standing Yovation® to: The Standing Yovation® Promotion - Pierre's Ice Cream Company, 6200 Euclid Avenue, Cleveland, Ohio 44103-3724. Entrants will be notified by phone if they are a winner. For the Weekly drawings (described below), mail-in entries must be postmarked by 08/15/09. Mail-in entries become the property of the Sponsor and will not be returned.

3. JUDGING: The judges will review all eligible entries submitted online and via mail and will select one (1) Prize Winner per week to win the Standing Yovation® Promotion. Winners will be notified by phone. Judges will evaluate each entry looking for inspirational and deserving individuals who have made a positive impact on a community or in the lives of others. All decisions of the judges shall be final and shall not be subject to review.

4. WEEKLY DRAWINGS: One Prize Winner of The Standing Yovation® Promotion will be selected each week. Odds of winning a Prize depend on the total number of eligible entries received. Limit one Standing Yovation® per person, company, or group.

5. PRIZES: Each Winner will receive five (5) Quarts of Yovation® Probiotic Frozen Yogurt (assorted flavors), 50 Bowls, 50 Spoons, 100 Napkins, 2 Ice Cream Scoops, 1 Table Cover, 6 Signs / Invitations, 25 - 55¢ off coupons for Yovation® Probiotic Frozen Yogurt, 1 Award Certificate, 1 Standing Yovation Badge, 1 Card from Sender.  The Standing Yovation® date should be scheduled within in a two-week period from the applicable Weekly Prize drawing date. (Estimated Retail Value of one Prize: $185). Total approximate retail value for all prize winners is $20,000. Prizes are non-transferable and non-assignable, with no cash redemptions. There will be no substitutions for the Prizes.

6. NOTIFICATION: Winners will receive their Standing Yovation® at the nominee's address submitted with their nominator's entry. Winners will be phoned by a Pierre's Representative to make them aware of their prize. Winners must accept their prize within two (2) weeks of the drawing. Pierre's Representative will make two (2) attempts to contact the winner. Failure to respond to messages or contact will result in disqualification and cause an alternate winner to be chosen from among all remaining eligible entries.

7. WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in The Standing Yovation® Promotion and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering The Standing Yovation® Promotion, each participant agrees to waive any and all claims against the Sponsor, and each of their respective agents and representatives for any injury, damage or loss that may occur from the participation in The Standing Yovation® Promotion or from the receipt or use of any prize or travel related to the receipt or use of any prize. Participants agree to allow Sponsor, and their designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.

8. GENERAL CONDITIONS: The Sponsor and each of their agents and representatives are not responsible for printing or typographical errors in any Promotion-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. The Sponsor and each of their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Promotion. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion. The decisions of Sponsor, including the selection of Winners, are final and binding on all matters relating to this Promotion.

Any attempt to deliberately damage the content or operation of The Standing Yovation® Promotion is unlawful and subject to legal action by the Sponsor or their agents. Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Standing Yovation® Promotion, and to resolve all disputes in their sole discretion. Sponsor (i) makes no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of Cuyahoga, State of Ohio.

Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Sponsor corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Standing Yovation® Promotion at the time of such cancellations.

9. WINNERS' LIST: For a list of winners, mail a self-addressed stamped envelope by 09/01/09 to The Standing Yovation® Promotion - Pierre's Ice Cream Company, 6200 Euclid Avenue, Cleveland, Ohio 44103-3724. Winners' list will be available after 09/15/09.

10. SPONSOR: Pierre's Ice Cream Company, 6200 Euclid Avenue, Cleveland, Ohio 44103-3724. There will be a total of one hundred ten (110) prizes awarded in this contest.
